Methodology of murder investigation with the focus on the use of trace evidence Abstract The thesis deals with the investigation of murder as one of the most serious forms of crime. After a general definition of the investigative methodology, the text focuses on the issue of trace evidence and its use in criminal proceedings, including potential challenges associated with it. Firstly, the current legal regulation of homicides in the Czech Criminal Code is briefly discussed. This is followed by a section devoted to statistics on the number of registered murders and the clearance rate, which are compiled annually by the Police of the Czech Republic, with a brief commentary. The investigative methodology of murder is initially introduced in general terms, followed by a description of its selected components. Attention is focused on the crime scene examination process, the examination of the corpse and the forensic autopsy, as these are crucial initial tasks through which police authority obtains valuable information. The remaining parts of the thesis focus on the forensic specifics of trace evidence, its collection and examination, interpretation, and procedural value, with emphasis on some of its limits. Methodology of Investigation of Murders Abstract Methodology of invecstigation of murders includes criminologistic characteristic of a murder and also a proces of investigation of murders and another crimes aganinst life by a law enforcement agency. This thesis if focused on the methodology of invecstigation of murders, while at its end it is focused on serial murders. This thesis describes murder itself as same as specifics of its investigation including a crime scene, primary and following acts of investigators and description of a murderer and a victim. The aim of this thesis is to link and describe single aspects of the murder itself and also of the methodolgy of investigation of murders and to merge them and get them in coherence, so i tis posibble to fully understand them. Methods of investigation of crimes committed by youth Methodology for investigation of crimes committed by youth is a compact system of procedures used by criminalists while investigating crimes committed by youth. For purposes of this thesis the term youth includes the category of age from twelve to twenty-four years. Well-elaborated methodology shall help criminalists to quickly and effectively deal with situations when there is a reasonable suspicion due to found traces, or method of committing a crime, that the offender was a person of this age category. This thesis introduces typical personal and psychological characteristics of youth. The thesis outlines which crimes are committed by this group most commonly and which factors cause the delinquent behavior of youth. The thesis presents typical traces which occur when youth commits crime, and methods of committing which point to the young age of offenders. According to these characters we can assume that the crime was committed by youth offender and therefore it is important to use a special methodology for the investigation. Cizojazyčné resumé The theme of this diploma thesis is the methodology of the investigation of sexual crimes and its selected issues. Given the large of this topic, I decided to focus only on methods of rape investigation, as a typical represenstative of this group of sexual crimes. The main objective is to identify the problems in the procedure of understanding and investigation. It focuses on the selected specifics which I attent to analyze and evaluate the current legal regulations. To clarify such a large topic, the thesis is divided into seven chapters. The introductory chapter deals with the current legislation of the rape and its historical evolution since the feudal period. This charter compares the Czech legal systém with foreign legal systems. The second chapter provides the statistical data and the typical criminalistics ways of committing this crime which is divided according to committting by adults and committing against children and adolescents. The third chapter deals with the rape from the criminological perspective and decribes the offender and the victim, their characteristics and presents typical characteristics on the case studies. Methodology of investigating specific homicides (focused on staged suicides) This diploma thesis deals with the methodology of investigating homicides and suicides, it determines the common and divergent traces left on a victim's body as well as on a crime scene and examines circumstances which motivate a perpetrator to stage a suicide. Last but not least, the thesis describes specific features of individual investigative acts. The aim of the thesis is not to bring a summary of the methodology of homicide investigation but it aims to draw the attention to the procedures typical for the investigation of murders which appear to be suicides and describes the ways how to distinguish staged suicides from the real ones. The thesis consists of six chapters. The first three chapters sum up the definitions of the terms homicide and suicide in criminal law and criminology, examine the circumstances prompting a murder perpetrator to stage a suicide, and describe the typical ways of committing homicides and suicides. 1 Abstrakt v anglickém jazyce The presented master's thesis is focused on methodology of sexual crime investigation and difficulties related to the methodology. Given the fact that the theme is quite vast, I decided to draw my attention to the crime of rape merely. The main aim of the thesis is to describe the process of recognition and investigation of the crime of rape emphasising its characteristic elements, problematic points, and crucial institutes. The thesis is divided into five chapters. The first chapter deals with a historical development of the legislation related to the crime of rape and takes fundamental sources of law into consideration. The chapter also includes current legislation of the crime of rape, merits of the case and concepts explanation. The second chapter contains criminological characteristics of sexual assault. The third chapter is devoted to the description of characteristic features of the crime of rape from the point of view of criminalistic and the emphasis is put on the victim's characteristics, their harm, which can be caused by the crime, and behaviour which can affect the process of trails origin. 80 Abstract The aim of this thesis titled Methods of investigation of sexual crimes (selected issues) is to clarify methods of investigation of sexual crimes with special focus on rape. The thesis is divided into nine chapters and sub-chapters. Introduction defines the goal of the thesis. The first chapter describes term of rape and its development from 1852 to the present. The first chapter also includes statistical data for the year 2012. The second chapter describes criminological characteristics of rape relating to typical way of committing, offender and victim. The myth that most of the offenders are sexually deviant is refuted in this chapter. The third chapter analyzes typical traces with traditional distinction between traces in the mind and material traces. Biological traces are emphasized, because they are in the investigation of the crime of rape very common. The fourth chapter is divided into two sub-chapters devoted to typical investigative situations. Following fifth chapter deals with the scope of investigation.
